Mini-Photo Session Contract

Mini Sessions will be held at Tempe Market Place on Friday, December 9th, 2022.
Session Fee is $199. $99 non-refundable retainer is due at time of booking and the remaining $100 is due at session to guarantee your spot. Please keep in mind that time slot is not guaranteed until the retainer fee has been paid. This is a non-refundable retainer fee that goes toward your session. A balance $100.00 is due 24 hours before the session. You may also pay the entire payment ($199) at the time of booking. You can pay via:

Session Fee Includes: The time and talent of photographer, basic retouching and creative editing of images, as determined by the photographer, and 10 images to be downloaded by client from www.vplovephotography.com. Additional editing is available at additional expense to be determined by photographer. Additional prints or digital images may be available for purchase.
Retainer and Payment. Client agrees to pay photographer a retainer of $99 at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your session. If there is a balance, it is due 48 hours before the session.
Cancellation. No refunds will be given, but you may transfer your session to another party or use your credit on file for a future session. In case of inclement weather, Client and Photographer must agree on a re-shoot date.
Late Arrivals. Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session. Session starts at the agreed upon time. Since there will be back to back bookings for the mini sessions, it is strongly encouraged that client arrives 5 minutes prior to the start of your session.
Re-shoots/Refunds. Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up or hair related issues or by not following the recommendations of the photographer.
Gallery Uploads - The proofs will be ready within 1-2 days after session date. You will have 7 days to choose your final 10 images as well as make any additional purchases. The gallery will only remain active for 7 days after that. Should your gallery expire and you need your images re-uploaded there is an upload fee of $50 per gallery.
Photographic Materials. All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of the Vicki Love Photography. Your final high-res edited proofs shall be available to the Client within 1-3 days after the final 10 selection.
Copyright and Reproductions. The Photographer owns the copyright for all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website and/or studio. The client signing this contract warrants that he or she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Photographer in the event of litigation arising out of such use. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright Law Title 17, Appendix V. Additional Provisions of the Digital Millennium Copyright Act 2005, Section 102} without the written permission of the Photographer.
Client’s Usage. The Client shall only use the prints, including digital files, in accordance with the permissions within this agreement. The Client’s prints are for personal use only and shall not be submitted to contests, reproduced for commercial use or authorize any reproductions by parties other than the Photographer. If the Photographer provides a digital file print release, the Client must act in accordance with the release.
Failure to Perform. If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the retainer to the client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited. If you fail to show up during your scheduled appointment you will forfeit all money paid.
Model Release. I grant permission for Vicki Love Photography, to take and use; printed or electronic publications, websites, or other electronic communications, media, advertising, promotion, marketing, and packaging for any products or service. I further agree that my name and identity may be revealed in text or commentary in connection with the image(s). I authorize the use of the images without compensation to me. All negatives, prints, digital reproductions shall be the property of Vicki Love Photography. Model Release approval must be made by a parent/guardian if any photo session participants are less than 18 years of age. I agree that this release is irrevocable, worldwide and perpetual. I have read and fully understand this information in this model release. I agree this model release is for everyone involved in the session.
Session Requests *No cameras/camcorders/any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between client and photographer. Session starts at the agreed upon time. It is strongly encouraged that client arrives 5-7 minutes prior to the start of session.
